O.N.3 サービス利用規約
本利用規約（以下「本規約」といいます）は、株式会社ハナウタ（以下「当社」といいます）が提供するカスタムパンプス製造・販売サービス『O.N.3』（以下「本サービス」といいます）の利用に関する条件を定めるものです。本サービスを利用されるお客様（以下「ユーザー」といいます）は、本規約に同意した上で本サービスを利用するものとします。
第1条（本サービスの概要）
本サービスは、ユーザーがスマートフォンアプリ上で自由にデザインしたパンプスを、当社が受注生産し、ユーザーに販売するものです。
第2条（知的財産権）
- 本サービスおよび『O.N.3』に関する著作権、商標権、その他一切の知的財産権は、すべて当社または当社にライセンスを許諾している第三者に帰属します。
- ユーザーがアプリ上で作成したデザインデータは、本規約に基づき、当社が製造、販売、およびサービス改善のために利用することに同意するものとします。
第3条（禁止事項）
ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。
- 法令または公序良俗に反する行為
- 犯罪行為に関連する行為
- 当社のサーバーまたはネットワークの機能を破壊したり、妨害したりする行為
- 当社のサービス運営を妨害するおそれのある行為
- 他者の知的財産権、肖像権、プライバシーの権利を侵害する行為
- 他者を誹謗中傷する行為
- その他、当社が不適切と判断する行為
第4条（商品の製造と引き渡し）
- ユーザーの注文確定後、当社は指定されたデザインに基づき商品を製造します。
- 商品の引き渡し時期は、注文確定後90日以内とします。受注生産のため、お届けまでにお時間をいただきます。
第5条（代金および支払い方法）
ユーザーは、本サービスを利用して購入する商品の代金を、当社の指定する方法（クレジットカード、銀行振込など）で支払うものとします。
第6条（返品・交換・キャンセル）
- 商品は、ユーザーのデザインに基づいて製造されるオーダーメイド品であるため、原則として返品・交換・キャンセルには応じられません。
- ただし、当社の責めに帰すべき事由（初期不良、配送中の破損など）がある場合は、この限りではありません。この場合、商品到着後7日以内に当社の定める方法でご連絡ください。
第7条（免責事項）
- 当社は、本サービスの利用によりユーザーに生じた一切の損害について、当社の故意または重過失による場合を除き、責任を負いません。
- ディスプレイ上で表示される商品の色や質感は、実際の製品と多少異なる場合があります。
- 当社は、システムの停止、通信回線の故障などによりユーザーに生じた損害について、責任を負いません。
第8条（規約の変更）
当社は、必要と判断した場合には、ユーザーに通知することなく、いつでも本規約を変更することができるものとします。
第9条（準拠法および合意管轄）
本規約の解釈にあたっては、日本法を準拠法とします。また、本サービスに関して紛争が生じた場合には、当社の本店所在地を管轄する裁判所を専属的合意管轄裁判所とします。
Terms of Service for O.N.3
This Terms of Service (hereinafter referred to as “the Terms”) sets forth the conditions for using the custom pumps manufacturing and sales service “O.N.3” provided by HANAUTA INC. (hereinafter referred to as “the Company”). By using the Service, the customer (hereinafter referred to as “the User”) agrees to these Terms.
Article 1 (Overview of the Service)
The Service is a platform where the Company manufactures and sells pumps that the User freely designs on a smartphone app, on a made-to-order basis.
Article 2 (Intellectual Property Rights)
- All copyrights, trademarks, and other intellectual property rights related to the Service and “O.N.3” belong to the Company or to third parties who have licensed them to the Company.
- The User agrees that the design data created on the app may be used by the Company for manufacturing, sales, and service improvement, in accordance with these Terms.
Article 3 (Prohibited Actions)
The User shall not engage in any of the following acts when using the Service:
- Acts that violate laws or public order and morals.
- Acts related to criminal activities.
- Acts that destroy or interfere with the functionality of the Company’s servers or network.
- Acts that may hinder the operation of the Service.
- Acts that infringe upon the intellectual property rights, portrait rights, or privacy rights of others.
- Acts that defame or slander others.
- Any other acts that the Company deems inappropriate.
Article 4 (Manufacturing and Delivery of Products)
- After the User’s order is confirmed, the Company will manufacture the product based on the specified design.
- The delivery time for the product is within 90 days after the order is confirmed. Please note that it takes time for delivery as the products are made to order.
Article 5 (Price and Payment)
The User shall pay for the product purchased through the Service using the methods designated by the Company (credit card, bank transfer, etc.).
Article 6 (Returns, Exchanges, and Cancellations)
- As the product is a custom-made item manufactured based on the User’s design, returns, exchanges, and cancellations are generally not accepted.
- However, this does not apply in cases of reasons attributable to the Company (e.g., initial defects, damage during shipping). In such cases, please contact us by the method specified by the Company within 7 days of the product’s arrival.
Article 7 (Disclaimer)
- The Company is not responsible for any damages incurred by the User due to the use of the Service, except in cases of willful misconduct or gross negligence on the part of the Company.
- The color and texture of the product displayed on the screen may differ slightly from the actual product.
- The Company is not responsible for any damages incurred by the User due to system failures or communication line issues.
Article 8 (Changes to the Terms)
The Company may change these Terms at any time without notifying the User if it deems necessary.
Article 9 (Governing Law and Jurisdiction)
The interpretation of these Terms shall be governed by Japanese law. In the event of a dispute related to the Service, the Tokyo District Court shall be the exclusive court of jurisdiction.
